Booking Terms and Conditions

1. Agreement and Booking Authority

By making a booking with My Cape Tours Pty Ltd (“we”, “us”, “our”), the lead person confirms they:

2. Jurisdiction and Supplier Conditions

These terms are governed by the laws of South Africa. Any disputes shall be resolved in South African courts. Independent suppliers operate some services under their own conditions, which may limit liability under international conventions.

3. Acknowledgement of Risk and Behavior

Our tours include elements of risk. You accept these risks and agree to behave respectfully. Disruptive behavior may result in immediate removal without refund. Clients are liable for any damage caused and associated costs.

4. Accuracy and Pricing

Prices and content are subject to change. We reserve the right to correct any errors and update unsold tour rates at any time.

5. Booking Confirmation

A booking is confirmed upon receipt of full payment. A confirmation email will follow immediately.

6. Special Requests

We cannot guarantee special requests. Noted requests are not confirmed unless explicitly agreed in writing.

7. Age, Fitness, and Medical Conditions

You are responsible for obtaining comprehensive travel insurance. We recommend doing so at the time of booking. Exclusions must be reviewed carefully, especially for high-risk or third-party activities.

9. Force Majeure

We are not liable for changes or losses caused by unforeseen events such as war, disease outbreaks, strikes, natural disasters, or government actions. Refunds in such cases are not guaranteed unless covered by insurance.

10. Reservations

All bookings must be made via our online booking platform.

11. Cancellation Policy

Third-party activity providers may enforce stricter terms. Weather-related cancellations may be fully refunded.

12. Payment Policy

Full payment is required in advance unless otherwise agreed. No service will commence without full payment.

13. Liabilities

We are not liable for injury, illness, loss, damage, or delays caused by third parties or events beyond our control. Clients must have travel insurance to cover these risks.

We are not responsible for loss or damage to luggage. Luggage is only transported with accompanying passengers unless a signed indemnity is provided.
